By downloading, installing, or using the MyRepsCount application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and MyRepsCount, its creator, developer, and affiliates (collectively, "we," "us," or "our").

2. Educational Purpose Only

The App is provided for educational and informational purposes only. It is not intended as:

• Professional fitness training or coaching
• A substitute for consultation with qualified healthcare providers
• A replacement for professional supervision during physical activity

3. Medical Disclaimer

The content and features provided by MyRepsCount do not constitute medical advice, diagnosis, or treatment. We are not medical professionals, and nothing in the App should be construed as establishing a doctor-patient relationship.

Never disregard professional medical advice or delay in seeking it because of something you have read or seen in the App. If you think you may have a medical emergency, call your doctor or emergency services immediately.

The App's AI-generated workouts and exercise recommendations are algorithmically generated and may not be suitable for your individual health condition, fitness level, or physical limitations.

4. Assumption of Risk

WARNING: Physical activity carries inherent risks.

You acknowledge and agree that your participation in any fitness program, physical activity, or exercise demonstrated or suggested through the App is a voluntary activity that has inherent risks, including but not limited to:

• Physical injury (minor or severe)
• Psychological injury
• Pain and suffering
• Illness or disease
• Disfigurement
• Temporary or permanent disability
• Death

You knowingly and freely assume all such risks, both known and unknown, even those risks that result from the negligence of others or the App's functionality.

5. Limitation of Liability

BY USING THIS APP, YOU AGREE TO RELEASE AND HOLD HARMLESS:

• MyRepsCount and its affiliates
• The creator and developer of the App
• All directors, officers, employees, agents, and representatives
• All successors and assigns

FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, OR RIGHTS OF ACTION, which are related to, arise out of, or are in any way connected with:

• Your use of the App
• Any injuries, damages, or losses you may sustain (including death)
• AI-generated workouts or exercise recommendations
• Pose detection accuracy or rep counting functionality
• Any technical failures, bugs, or errors in the App

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED
• WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP (WHICH IS ZERO FOR FREE VERSIONS)

6. Indemnification

You agree to indemnify, defend, and hold harmless MyRepsCount, its creator, developer, and all associated parties from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your participation in physical activities while using the App

7. AI-Generated Workouts

The App includes AI-generated workout recommendations powered by third-party AI services. These workouts are algorithmically generated and:

• May not account for your specific health conditions, injuries, or limitations
• May suggest exercises that are not appropriate for your fitness level
• May contain errors or unsafe exercise combinations
• Should be reviewed by a qualified fitness professional before use

If you have any injuries, pain, or health concerns, you must consult a healthcare professional before using AI-generated workouts.

8. Pose Detection and Rep Counting

The App uses MediaPipe and TensorFlow Lite for pose detection and rep counting. You acknowledge that:

• Pose detection may be inaccurate or fail entirely
• Rep counts may be incorrect or inconsistent
• The technology cannot replace proper form assessment by a qualified trainer
• Camera positioning, lighting, and other factors affect accuracy
• The App is not a substitute for proper exercise instruction

We make no guarantees regarding the accuracy or reliability of pose detection or rep counting features.

9. User Responsibilities

When using the App, you agree to:

• Consult with a healthcare provider before starting any fitness program
• Exercise in a safe environment with adequate space and equipment
• Use proper form and technique for all exercises
• Stop immediately if you experience pain, dizziness, or discomfort
• Warm up properly before workouts and cool down afterward
• Stay hydrated and take breaks as needed
• Not rely solely on the App for exercise instruction or safety guidance
• Accept full responsibility for your physical safety during workouts

10. Privacy and Data Collection

Your use of the App is also governed by our Privacy Policy. Please review it carefully.

Key Privacy Points:

• All workout data is stored locally on your device
• No video, images, or personally identifiable workout data is sent to our servers
• We use Google AdMob for advertisements, which may collect device identifiers and usage data
• Camera access is required for pose detection but video is processed locally only

11. Advertising

The App displays advertisements through Google AdMob. By using the App, you agree that:

• Ads may be displayed during your use of the App
• AdMob may collect data for personalized advertising
• You can control ad personalization through your device settings
• We are not responsible for the content of third-party advertisements

12. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of MyRepsCount, its creator, or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the App without our prior written consent.

13. Third-Party Services

The App uses several third-party services and libraries:

• Google AdMob - Advertising platform
• OpenAI API - AI-generated workout content
• MediaPipe - Pose detection technology
• TensorFlow Lite - Machine learning inference

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or performance of these third-party services.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page.

Your continued use of the App after any modifications indicates your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the App immediately.

15. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Behavior that harms or threatens others

Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including but not limited to liability disclaimers, indemnification obligations, and limitation of liability.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the creator resides, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyRepsCount regarding your use of the App and supersede all prior agreements and understandings.

BY CLICKING "I AGREE" OR BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT:

• You agree to be bound by these Terms
• You understand the risks associated with physical activity
• You voluntarily assume all such risks
• You release MyRepsCount, its creator, developer, and affiliates from all liability
• You agree to the limitation of liability and disclaimer of warranties
